2. Using This Website
The content on this website is provided for general information only. Browsing this site or contacting us does not create a client relationship. A client relationship begins only when both parties sign a written proposal or agreement. Nothing on this site guarantees marketing outcomes or replaces the terms of a signed agreement.
3. Proposals and Agreements
Each engagement is defined by a written proposal or service agreement covering scope, deliverables, timeline, fees and responsibilities. If the signed agreement conflicts with these Terms, the signed agreement prevails.
4. Fees and Payment
Project work requires a 50% deposit before work starts, with the balance due on delivery. Monthly retainers are billed in advance. Invoices are due within 14 days. Late payments may incur interest and we may pause work on overdue accounts until payment is received.
5. Client Responsibilities
Clients must provide timely access to accounts and systems, supply content and feedback, and give approvals when requested. Delays caused by missing inputs may move agreed timelines.
6. Changes to Scope
Any change to the agreed scope will be documented and quoted before it affects cost or schedule. Work outside the agreed scope does not begin until the client approves the revised quote.
7. Cancellation and Refunds
Monthly retainers may be cancelled with 30 days written notice. Deposits are non-refundable. Work completed up to the cancellation date is billable and will be invoiced.
8. Intellectual Property
On full payment, ownership of the agreed deliverables transfers to the client. We keep ownership of our pre-existing tools, methods, templates and know-how, and we may reuse general techniques learned during an engagement. Unless the client asks us not to, we may show completed work in our portfolio.
9. Third-Party Platforms
Results on third-party platforms such as Google, Meta, app stores and AI platforms depend on those platforms. We do not guarantee search rankings, ad performance, platform approvals or revenue.
10. Confidentiality
Both sides will keep the other's confidential information private and use it only for the purposes of the engagement, except where disclosure is required by law.
11. Limitation of Liability
To the extent the law allows, our total liability for any claim is limited to the fees paid for the relevant service in the 12 months before the claim. We are not liable for indirect or consequential loss.
12. Governing Law
These Terms are governed by the laws of Western Australia, unless the signed client agreement states otherwise.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top shows the latest version. Continued use of the website after changes means you accept the updated Terms.
